GENERAL TERMS AND CONDITIONS OF SALE - L'ATELIER SONIA DAUBRY - FROM JANUARY 1, 2022



Item 1:Scope of the General Conditions of Sale These General Conditions of Sale (hereinafter the "GTC") These conditions of sale aim to define the contractual relationship between soniadaubrydesign.com and the buyer and the conditions applicable to any purchase made remotely and electronically through the merchant site soniadaubrydesign.com, whether the buyer is a professional or a consumer.

The acquisition of a good or a service through this site implies unreserved acceptance by the buyer of these conditions of sale. The Buyer therefore acknowledges having read them and accepting them fully, entirely and without reservation. No particular condition, no use, no previous agreement, in any form whatsoever, can prevail against the terms of these GCS, unless prior, express, written and formal acceptance by the Seller.

These conditions of sale are concluded on the one hand by the company L'ATELIER SONIA DAUBRY, SASU with a capital of 1,500 euros whose registered office is in Crécy-la-Chapelle, at 3 rue Serret, registered in the commercial register and Meaux companies under number 832 820 435 hereinafter referred to as "L'ATELIER SONIA DAUBRY" and on the other hand, by any natural or legal person wishing to make a purchase via the soniadaubrydesign.com website hereinafter referred to "the buyer".



Section 2.Characteristics of the goods and services offered. The products and services offered are those listed in the catalog published on the soniadaubrydesign.com site. Each product is accompanied by a description drawn up by the supplier.



Section 3.Fabric Claims

 

It is essential to check the goods before any use. 

The buyer is the sole judge of the use he makes of the goods ordered. He is solely responsible for the consequences resulting from this use and it is up to him to choose the qualities that suit the destination he intends to give them, in particular for use as wall hangings.

Depending on the ambient humidity, variations in width and length, especially for curtains, are considered normal, especially in the event of cleaning.

In the event of fabric recognized as defective, soniadaubrydesign.com's liability is strictly limited to the value of the invoiced fabric and cannot under any circumstances be extended to any other reimbursement (labour, supplies, damages, etc.). Any complaint must be made by registered letter with AR within 10 days of delivery of the goods.

Section 3-1:Wallpaper complaints

Upon receipt of your order, it is essential to check that none of the rolls are damaged and that the wallpaper and colors are correct. Papers can be rolled in either direction. Before laying, you need to make sure that the pattern is in the right direction. You must check that the installer has read the attached installation instructions. We decline all responsibility for defects that were visible before installation.

Once the wallpaper has been applied, we cannot accept responsibility for any errors. 

After laying 3 or 4 lengths (1 roll maximum) the installer must inspect the result to ensure that there are no faults. No complaint will be taken into account if several rolls are placed with the same defect.

In the event of wallpaper found to be defective, soniadaubrydesign.com's liability is limited at most to the value of the wallpaper invoiced and cannot under any circumstances be extended to any other reimbursement (labour, supplies, damages, etc. ). Any complaint must be made by registered letter with AR within 10 days of delivery of the goods.

Clause 4:Differences in shades of colors The seller is responsible for communicating to the customer the essential characteristics of the products.

The photographs in the catalog are as faithful as possible but cannot always ensure perfect similarity with the exact shade of color of the product offered. It is emphasized that computer screens may have significant differences in color rendering.

Production constraints mean that there may be color variations between different dye baths or manufacturing batches. If the customer wants to know the exact shade of color he will receive.

No complaint can be received concerning a difference in shade of color between several batches or manufacturing baths, if the buyer has placed several distinct orders.



Clause 5:Prices. The prices appearing in the catalog are prices inclusive of VAT in euros taking into account the VAT applicable on the day of the order; any change in the rate may be passed on to the price of the products or services.

soniadaubrydesign.com reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.

The prices indicated include order processing costs but do not include transport and delivery costs.



Section 6:Import duties, fees and taxes. With regard to products shipped to overseas departments and territories and countries outside the European Union, customs duties, fees or local import taxes may be required by the tax or customs services. Their payment remains in all cases the responsibility of the buyer.



Clause 7:Orders. The language offered for the conclusion of the contract is French. The contract will be, in application of the provisions of the Civil Code, concluded from the second click of the order, by which the buyer will have confirmed his shopping cart after having been able to correct it.

The buyer, who wishes to buy a product or service must:

  • fill in the identification form on which he will indicate all the contact details requested or give his customer number if he has one

  • complete the online order form giving all the references of the products or services chosen

  • confirm your order after checking it

  •  confirm your order and payment

  • make the payment under the conditions provided


In accordance with the provisions of the Civil Code on the conclusion of online contracts, the contract will be concluded when you click on the button allowing you to confirm your order after having viewed the details of it and in particular its total price and having had the possibility to correct any errors.

Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of its own conditions of purchase or other conditions.

All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions.

The seller will communicate by e-mail confirmation of the registered order.



Section 8: Delivery & returns

Transport is free from a purchase of €150 including tax for all your deliveries in mainland France and Belgium. For any lower amount, a flat rate of €8 including tax is applied, regardless of the number of products shipped. Deliveries are made to the address indicated in the order form.

In the event of damage during transport, the reasoned protest must be made by registered letter with acknowledgment of receipt to the carrier within 3 days of delivery.

For professional customers subject to specific commercial conditions, the risks are borne by the purchaser from the moment the products have left their place of dispatch. From delivery. please note that upholstery, wallpaper or rugs are bespoke and we do not accept returns or cancellations once the order has been placed.

The exercise of the right of return is excluded for the following products or services:

  • services started to run with your permission

  • products made according to the consumer's specifications or clearly personalized (in particular, and without this list being exhaustive, furniture personalized with a fabric of your choice, carpets made to your measurements, wallpaper panels made to your measurements) .




Section 9:Delivery time. On each product sheet is the delivery time in metropolitan France.

Under no circumstances may any delay entitle the buyer to claim damages.



Clause 10:Payment.

ATELIER SONIA DAUBRY SASU whose head office is at 3 rue Serret 77580 Crécy-la-Chapelle has its accounts domiciled at CIC.

Payments will be secured by the STRIPE payment system. Information about this system is available on the websitestripe.com. All information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by third parties. They are also not stored on our computer systems.

Payments will be made by credit card (CB, Visa, MasterCard) or by bank transfer. Under no circumstances does soniadaubrydesign.com have access to its customers' bank details.

The account of the purchaser will be debited only during the validation of the payment of the order and during the validation of the amount of the products sent and the delivery costs. For further information :contact@soniadaubrydesign.com


At the request of the buyer, he will be sent a paper invoice showing the VAT.



Clause 11:Legal warranties. All the products supplied by the seller benefit from the legal guarantees:

 

  • guarantee of conformity of the goods with the contract (articles L211-1 and following of the Consumer Code)

  • warranty against hidden defects (articles 1641 to 1649 of the Civil Code)

  •   contractual warranty


In the event of non-compliance of a product sold, it may be returned to the seller who will take it back, exchange it or refund it.

All complaints for lack of conformity or warranty action for hidden defects must be sent by post or by e-mail. No return of packages should be made before registering your complaint and sending return instructions.



Clause 12:Responsibility. The seller, in the online sales process, is bound only by an obligation of means; its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.



Section 13:Intellectual property. All elements of the soniadaubrydesign.com site are and remain the exclusive intellectual property of L'ATELIER SONIA DAUBRY.

No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound. The Seller is the exclusive owner, without any reservation, of all models of the products and goods. The reproduction, adaptation or use of the models, the name and/or the L'ATELIER SONIA DAUBRY brand are strictly prohibited in any form whatsoever (photos, sketches, patterns, clothing, etc.). Failure to comply with this essential condition and the legal provisions on intellectual property would constitute an act of counterfeiting and/or unfair competition, punishable by the laws in force and likely to lead to the termination of the contract at the exclusive fault of the 'Buyer. No advertising featuring the L'ATELIER SONIA DAUBRY brand and/or the brand's products may be made without the Seller's prior, express and written consent.



Section 14:Protection of personal data. In accordance with the law relating to data processing, files and freedoms of January 6, 1978, information of a nominative nature relating to buyers may be subject to automated processing.

The personal data collected on our site is used to process orders and manage the commercial relationship (deliveries, invoices, after-sales service). We may also use your data for advertising purposes, either after obtaining your express consent or within the limits permitted by law. We are also likely to use your data to meet our legal and/or regulatory obligations, where applicable.

The recipients of your personal data are, where applicable, our payment service providers, our delivery providers, our business partners. In the event that it is provided for by law, your consent is obtained or you are given the possibility of refusal before any transmission of data.
